TAC Vape legal in Germany – what you need to know in 2026
The first question almost everyone asks before buying a TAC Vape: Is this actually legal? The short answer is yes. But because the topic of cannabinoids regularly causes confusion in Germany – and because the laws have changed several times over the last two years – we explain here exactly what is permitted, why it is permitted and what you should still bear in mind.

Why TAC Vapes are legal – the simple explanation
TAC stands for Total Active Cannabinoids – the total amount of all active cannabinoids in a product. We've already explained in detail what TAC means exactly and how it is made up. What matters for the legal situation is this: TAC is not a single active ingredient, but a figure that describes the composition.
What determines legality is not the TAC value, but which cannabinoids the product contains. All Happy's Amsterdam TAC Vapes contain only cannabinoids that are permitted under current German and EU law. No THC, no HHC, no 10-OH-HHC – all substances that are banned or regulated in Germany.
The result: our TAC Vapes are 100% legal and marketable in Germany – with full labelling, independent lab analyses and a transparent supply chain.
What changed in 2024 and 2025?
The cannabinoid market has been in flux in recent years. For a long time, HHC was the best-selling alternative active ingredient – until the European Commission and the German legislator stepped in. 10-OH-HHC was banned too, as were H3 and H2 vapes. Products that were on the shelves yesterday became illegal overnight.
That's exactly why, from the very beginning, we've relied on a product concept that isn't based on a single active ingredient on shaky regulatory ground, but on a broad, transparently labelled cannabinoid mix made from industrial hemp extract. TAC as a concept is more robust than any single cannabinoid that may be permitted today and banned tomorrow.

TAC Vapes and driving – what are the rules?
After legality, this is the question we're asked most often. The honest answer: we don't recommend it.
From a legal point of view, our TAC Vapes contain no THC – the active ingredient that is relevant on the road. Since August 2024, the legal limit in Germany has been 3.5 nanograms of THC per millilitre of blood serum. Whether and for how long cannabinoids can be detected in tests depends on many factors – we can't give any guarantee on this.
Nevertheless: TAC Vapes contain active cannabinoids that can affect your reactions and perception. Anyone who has used a vape and doesn't feel fit to drive but gets behind the wheel anyway is acting negligently and could face legal problems – regardless of whether a drug test comes back positive or not. German driving-fitness law also recognises the offence of relative unfitness to drive (relative Fahrunsicherheit), which is not tied to a limit.
In short: vaping and then driving is not a good idea – for safety reasons, not because of a formal ban. If you want to drive safely, leave enough time.
Detectability: how long does TAC stay in your blood?
We can't guarantee that a drug test will come back negative – testing methods differ and cross-reactions are possible. Standard drug tests on the road and in the workplace look for THC, THC-COOH (the breakdown product of THC), cocaine, amphetamines, opiates and similar substances.
An important note: there are rapid tests that react to cannabinoids in general and don't distinguish cleanly between THC and other compounds. These tests are of limited reliability and are only legally recognised as a preliminary test – an analysis that can be used in court is always carried out in a lab. Even so, a false-positive rapid test can lead to an unpleasant situation.
For jobs with drug testing (e.g. driving services, certain public authorities): if in doubt, find out in advance which substances are tested for, and if in doubt, don't consume. Our product pages list the ingredients.
Age limit and purchase requirements
Our TAC Vapes are exclusively for people aged 18 and over. Buying, possessing and consuming them is only permitted from this age – just like alcohol and tobacco products. This isn't just a legal obligation; it reflects our idea of responsible use.

TAC vs. HHC, THC and CBD – the legal difference at a glance

HHC (hexahydrocannabinol) was the most popular legal alternative to THC until 2023/2024. HHC is now no longer marketable in the EU and falls under the New Psychoactive Substances Act (NpSG).
