A. Right of withdrawal

Introduction

Consumers have a right of withdrawal as set out below. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (Nexus Innovations GmbH, Kieselweg 10, 44269 Dortmund, Germany, phone: +49 176 23921185, email: info@happys-amsterdam.de) of your decision to withdraw from this contract by means of a clear statement (for example a letter sent by post or an email). You may use the enclosed model withdrawal form for this, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient to send your notice of exercising the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we must reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery we offer), without undue delay and no later than fourteen days from the day on which we received your notice of withdrawal. For this reimbursement we use the same means of payment you used for the original transaction, unless expressly agreed otherwise with you. In no case will you be charged any fees because of this reimbursement. We may refuse reimbursement until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is earlier.

You must send the goods back to us or hand them over without undue delay and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods, unless the goods were damaged on delivery. In that case, contact our support and we will create a free return label for you.

You are only liable for any loss in value of the goods if this loss in value results from handling that was not necessary to check the condition, properties and functioning of the goods.

Exclusion or early expiry of the right of withdrawal

Please note that the right of withdrawal expires early for the following goods:

• Sealed goods: This applies to items that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery.
