TAC Vape legal in Germany – what you need to know in 2026

The first question almost everyone asks before buying a TAC Vape: is this even legal? The short answer is yes. But because the subject of cannabinoids regularly causes confusion in Germany – and because the laws have changed several times in the past two years – here we explain what exactly is permitted, why it is permitted and what you should nevertheless bear in mind.

Why TAC Vapes are legal – the simple explanation

TAC stands for Total Active Cannabinoids – that is, the total amount of all active cannabinoids in a product. We have already explained in detail what TAC means exactly and how it is made up. What matters for the legal situation is this: TAC is not a single active substance but a figure describing the composition.

What is decisive for legality is not the TAC value but which cannabinoids the product contains. All Happy's Amsterdam TAC Vapes contain exclusively cannabinoids that are permitted under currently applicable German and EU law. No THC, no HHC, no 10-OH-HHC – all substances that are banned or regulated in Germany.

What changed in 2024 and 2025?

The cannabinoid market has been in flux in recent years. HHC was the best-selling alternative active substance for a long time – until the EU Commission and the German legislator stepped in. 10-OH-HHC was banned too, as were H3 and H2 Vapes. Products that were still on the shelf yesterday became illegal overnight.

That is precisely why, from the very beginning, we opted for a product concept that is not based on a single, regulatorily fragile active substance, but on a broad, transparently declared cannabinoid mix from industrial hemp extract. As a concept, TAC is more robust than any individual cannabinoid that can be permitted today and banned tomorrow.

TAC Vapes and driving – what applies?

This is the question asked most often after the one about legality. The honest answer: we do not recommend it.

Legally speaking, our TAC Vapes contain no THC – the active substance that is relevant in road traffic. Since August 2024, the statutory limit in Germany has been 3.5 nanograms of THC per millilitre of blood serum. As our products contain no THC, you will not test positive for THC in a standard drug test.

Even so: TAC Vapes contain active cannabinoids that can affect your reactions and your perception. Anyone who has used a vape and does not feel fit to drive but still gets behind the wheel is acting negligently, and that is legally problematic regardless of whether a drug test comes back positive or not. Driving-fitness law also recognises the concept of relative unfitness to drive, which is not tied to any threshold value.

In short: vaping and then driving is not a good idea – for safety reasons, not because of a formal ban. Anyone who wants to drive safely allows enough time to pass.

Detectability: how long does TAC stay in your blood?

Because our TAC Vapes contain no THC, they cannot be detected in a THC drug test. Standard drug tests in road traffic and in companies look for THC, THC-COOH (the breakdown product of THC), cocaine, amphetamines, opiates and the like – not for the cannabinoids contained in our products.

One important note: there are rapid tests that react to cannabinoids in general and do not cleanly distinguish between THC and other compounds. These tests are limited in what they can tell you and are legally recognised only as a preliminary test – an analysis admissible in court is always carried out in a laboratory. Nevertheless, a false-positive rapid test can lead to an unpleasant situation.

For professions with drug testing (e.g. driving services, certain public authorities): if in doubt, clarify in advance which substances are tested for. Our product page lists all ingredients transparently – you can present this information at any time.

Age limit and purchase requirements

Our TAC Vapes are exclusively for people aged 18 and over. Purchase, possession and consumption are only permitted from that age – just as with alcohol and tobacco products. That is not only a legal obligation but also matches our understanding of responsible use.

In the online shop, age is verified at the point of purchase. In our physical locations – from Berlin to Munich – age is checked at the till.

Why "Don't panic, it's legal" is more than a slogan

TAC vs. HHC, THC and CBD – the legal difference at a glance

THC (tetrahydrocannabinol) is the classic psychoactive cannabinoid from cannabis. In Germany, THC is classified as a narcotic. For consumers without a doctor's prescription, possession of 3 grams or more is a criminal offence. In road traffic, the 3.5 ng/ml limit applies. HHC (hexahydrocannabinol) was the most popular legal alternative to THC until 2023/2024. HHC is no longer marketable in the EU and falls under the German New Psychoactive Substances Act (NpSG). Anyone buying HHC products is moving in a legal grey area or clearly into illegal territory.

Can I buy TAC Vapes legally online?

Yes. All TAC Vapes from Happy's Amsterdam can be ordered legally online – in Germany, Austria and Switzerland. The prerequisite is a minimum age of 18.

Are TAC Vapes allowed when travelling in the EU?

In most EU countries our products are legal – but the rules differ. We recommend briefly checking the legal situation in your destination country before travelling. Switzerland applies different limits for some cannabinoids than Germany.

What happens if new laws restrict TAC Vapes?
